Terms of Service

These Terms of Service apply only to the blackwall.observer website and the Blackwall Discord application (App ID: 1519986517185921136), as both are operated on self-hosted infrastructure.

1. Acceptance of Terms

By inviting the Blackwall bot ("the Service") to your Discord server or by using the Blackwall web dashboard, you ("you", "your") agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is self-hosted software operated by the person or organization that deployed this instance (the "host"). The original Blackwall developers ("we", "us", "our") provide the software but do not operate or control individual instances.

2. Description of Service

Blackwall is an automated anti-spam and moderation bot for Discord. The Service provides real-time message scoring, raid detection, automated enforcement actions, and a web-based dashboard for configuration. Because the Service is self-hosted, the host may modify, suspend, or discontinue any feature of the Service at any time without notice. The original developers reserve the right to modify, suspend, or discontinue the software project itself, including updates and source code availability.
The underlying source code is provided subject to its open-source license LICENSE.md, while these Terms govern the use of this specific deployed instance.

3. Eligibility

You must be at least 13 years old (or the minimum age required to use Discord in your jurisdiction) and have the authority to add bots to the Discord server in question. By using the Service you represent that you meet these requirements.

4. Acceptable Use

Instance owners and users agree not to:

• Use the Service to violate Discord's Terms of Service or Community Guidelines, including but not limited to harassment, hate speech, illegal content, or coordinated platform abuse.
• Use the Service to unlawfully target, surveil, or collect personal data from Discord users.
• Attempt to exploit or attack the Service or its underlying systems.
• Abuse, overload, or attack the host's infrastructure, APIs, or network resources.
• Sell or redistribute the Service without the written permission of the original developers.

Instance owners are solely responsible for configuring the Service in a manner that complies with Discord's Terms of Service, Community Guidelines, and applicable law. The original developers are not responsible for how an instance owner configures or deploys the bot.

5. User Content

The Service processes message metadata and content from your Discord server solely for the purpose of spam detection and moderation. We do not claim ownership of your content. You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining any necessary consent from your server members.

6. Disclaimers & "As-Is" Provision

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or that it will detect all spam or malicious activity.

The original developers do not guarantee that the software will function correctly on any given self-hosted instance. Updates to the software may introduce bugs or breaking changes that affect existing instances. The host is responsible for testing updates before deployment and for maintaining the stability of their own infrastructure.

Web dashboard downtime, database corruption, Redis failures, network outages, or any other disruption caused by the host's infrastructure is the sole responsibility of the host. The original developers are not liable for any downtime or data loss resulting from the host's deployment choices.

You use the Service entirely at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, neither the original developers nor the host shall be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

The Service is an automated moderation tool that takes enforcement actions (message deletion, timeouts, kicks, and bans) based on configurable rules. The original developers are not responsible for the actions of the bot on any given server. This includes, but is not limited to:

• Misconfiguration: if the bot is configured with overly aggressive thresholds or incorrect enforcement actions (e.g., banning instead of deleting), and as a result kicks, times out, or bans legitimate users — including an entire server's user base — the original developers are not liable for any resulting damage, data loss, or community disruption.
• False positives: the bot may incorrectly flag legitimate messages as spam. The original developers are not liable for any wrongful deletion, timeout, kick, or ban.
• Software defects: bugs in the software may cause unexpected behavior, including unintended enforcement actions. The original developers are not liable for any damage caused by such defects on a self-hosted instance.
• Host infrastructure failures: downtime, data loss, or service disruption caused by the host's infrastructure (e.g., VPS provider, database, Redis) is the sole responsibility of the host.

The host of this instance is an independent operator, not an agent, employee, or partner of the original developers. The host bears full responsibility for the deployment, configuration, and consequences of running the Service on their infrastructure.

8. Indemnification

Instance owners agree to indemnify and hold harmless both the original developers and the host of this instance from any claims, damages, or expenses arising from their use or configuration of the Service, including but not limited to claims arising from enforcement actions taken by the bot, false positives, data loss, or violation of these Terms or Discord's Terms of Service.

9. Termination

You may stop using the Service at any time by removing the bot from your Discord server and deleting your account from the web dashboard. The host may terminate or restrict access to the Service at their sole discretion, without notice. The original developers may discontinue the software project at any time, including ceasing to provide updates or source code.

10. Changes to These Terms

We may update these Terms from time to time. We will reflect the date of the latest revision above. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

Disputes regarding the operation of this specific instance shall be governed by the laws of the jurisdiction in which the host operates. Disputes regarding the underlying software and the original developers shall be governed by the laws of Portugal, without regard to conflict of law principles.
